when a company is purchased Assets equals Equity plus liabilities . Therefore LA Fitness must take full responsibility
to honor all lifetime members of BAlly's .Whoever is starting the class action lawsuit lets get the party started I plan to contact the state attorney tomorrow will follow up with advice for all . If someone else has any ideas please share

Listen, it would be a sham if the equipment started to malfunction due to heavy use. I have a year left on my membership and I can bet that I will wear those machines down and cost LA some serious cash I'll definitely get my money's worth when I'm Done. What comes around goes around. Who's with me???

I have a "premier" bally membership also and have been paying $182.60, yearly. They no longer want to charge me this: LA FITNESS claim that I should now pay $255.00. If enough of us get together, a class action law suit can take place especially since Bally was sold without our knowledge or even a letter of the takeover. I found out when I went to the gym and Bally's told me of the changeover and the increase of yearly membership: THAT'S CROOKED. A CLASS ACTION LAW SUIT is the only way TO FIGHT BACK. My wife is getting ripped off from Bally Total Fitness. She has had a Premier membership that allows her to use any BTF for over 15 years. Now they tell her she can know longer use the local gym because it belongs to LA Fitness now. I am interested in joining in a lawsuit against Bally Total fitness if possible.

I have the same problem as everyone else. I contacted an attorney who informed me that there would be little recourse and that the best thing to do would be to file a complaint with the FTC as suggested by "anonymous" (below on 1/3/12 AT 1:20PM). I have done this and would advise everyone else to do the same...it is an easy form on the FTC's website.

I inheritited my father's lifetime membership in 2008 and paid the annual dues for 2 years. I let this last year lapse because the local Bally's I go to was filthy. I also had an LA fitness membership that I wanted to stop paying on as money is tight. The LA fitness people told me they would but could not find me in the Bally's system. When I called Bally's they told me that they did not have to transfer me in the sale since I let my dues lapse these last few months, and that I have nothing now and have to buy a new contract from either Bally's or LA fitness. When I said I was not notified that my contract was lapsed and that it would put me in default of the terms of the agreement, they said they did not have to. They said it was in the fine print on the version my dad had signed in 1987 before he passed away, but they did not have that either. I took the guys name and number but he basically told me to go away and leave them alone as he had no more to say about it.

I have the same problem. I went to LA fitness and they have no record of me. Since my Bally's location was not purchased, i am still a Bally's member and can not use the LA fitness. If I go to out of NY and the Ballys' there have been bought out by LA fitness, i can not use them. So I seem to have gotten screwed. I guess i should have changed my "home" club to the one i usually used, which was bought out....

Same problem as the rest of us here. My home club is no where near where i am and wasnt brought by LA Fitness, and the club that i have been using is now LA fitness in Lake Grove NY and I am now out of luck. The closest Bally's is at least an hour away. Unfair. My membership is now useless. Something needs to be done.

I felt a little strange when I went to Torrance branch in this morning. There were a few people workout. I have Premier Plus membership which is very good deal. A clerk told me that I have to sign a new application for LA fitness, and of course, they will charge me for money. My membership was originally from WI, where Bally didn't sell it, so my account did not transfer to LA fitness. Do I still have a right to use the club? I'm tired to argue with the clerks. I understand they are just employee who do not know much thing about the takeover.

The Bally's here in San Diego (Mission Valley) was bought by LA Fitness on 12/30/11. I have 3 remaining personal training sessions with Bally's, but none of those trainers are with LA Fitness. LA Fitness has told me that I am not entitled to a refund, but I would be given my pt sessions as a courtesy. I told them that that was not what I wanted and insisted on a refund. About 3 weeks ago, the VP of LA Fitness assured me that he would look into it. Nothing happened there, but he was at my gym yesterday. I have now been told by the operations manager that they are going through Bally's for the refund process. It should take 5-7 days. I was told that there are over 1000 requests for refunds for various reasons. Hopefully my persistence has paid off, otherwise, we'll be in small claims court. The total due is $132.

I have the same issue as everyone here. I live nowhere near my so called home club so my membership was not transferred.

I have filed a complaint with the FTC (on line) and would recommend that all others that have a similar complains do likewise. In that way, the FTC can see that there is a trend and not isolated complaints.

I have a lifetime membership that was transfered to Bally's from Pac-west in
puyallup washington. I started going to ballys and a week later they were LA Fitness.
LA fitness was really nice to me and I worked out the month of December, but now they want me to pay for the month to month with LA fitness. I would like to be apart of the Lawsuit.

I purchased a personal training package at Bally's. Found out later Bally's trainers were not certified at all! When the tranfer to LA Fitness took place, all the trainers were let go because LA Fitness requires the trainers to be certified. I was told to wait a few weeks and LA Fitness would provide me with a trainer, but the transfer happened 3 weeks before my wedding when I need the training the most. I tried to get a refund and service at both LA Fitness and Bally's corporate were not helpful. Finally, I called my credit card company and the credit card company said they would handle the dispute. My credit card refunded me the money and they fight Bally's for the refund because I had a valid claim. Even if Bally's wont refund my credit card, I am allowed to keep the refund. If you need a refund, contact your credit card company directly and they will fight with Bally's customer service on your behalf.

Learned my Bally's club in Florida was sold to LA Fitness and would close as of 12/31/11. I originally bought my membership at Holiday Health in Rochester, NY which was then sold to Bally's. I moved to Florida 23 years ago and have used this Florida club exclusively since moving. LA Fitness has no record for me and will not honor my Bally's contract. Bally's will not transfer my membership to Florida so LA Fitness will recognize it. Basically I'm screwed and left holding my now worthless Bally's membership card. Any class action suits pending???

I just found out about Bally's being taken over by LA Fitness and they will not honor my "lifetime Membership". Clerk said they stopped doing it a couple of weeks ago. Told her I was never notified of the sale. She dialed Bally's number and said to speak to them. "Rick" stated sorry today is the last day to transfer and it cannot be done today. Requested to speak to a supervisor, and was put on hold for awhile and call was disconnected. Called back and spoke to Alex and asked him to put supervisor on the phone. I then spoke to George; his title is supervisor. He said they can no longer transfer memberships to LA Fitness; today was the last day but they stopped transferring a few weeks ago and there's nothing he can do. Told him I didn't believe it was fair because I was never notified. He said there is nothing he can do it's too late. Then he asked if he could help me with anything else. Told him he never helped me and told him to send me letter in writing stating what he just said because I will take this matter further.

12-29-11 went to La Fitness in St Paul MN today. They are now honoring your Bally fitness memebership. If you paid one year in advance or whatever you paid they are honoring it to the experation date. If you have a premier membership where you can go to any club they are honoring the same type of membership you have. They are also honoring the rate you had at Ballys.

My Bally's ID card lists my membership as "Premier", which should mean that I can use any gym, correct? However LA Fitness has me assigned to a single gym. I will be happy to partipate in a class action suit.

Thank you all for posting your concerns about this and for some sort of direction on this matter. I just entered a complaint to my state attorney general as recommended on this site. I bought my membership in '93. I can't find my original contract and lost my gold card years ago and was given their new one. They said they didn't give out gold cards anymore. My dues are up and I am being told that LA Fitness will only give me 2 years and that they know nothing about a lifetime membership. Please keep posting information on here as I am feeling really ripped off!! When I bought my contract, I was told it was for life! This stealth takeover should not be an exception! By the way, I was not mailed anything either. I emailed Bally's and was told to contact LA Fitness which was a futile effort! I hope the State Attorney General can do something!

Ballys went bankrupt, but L.A. Fitness mailed me a letter informing that they bought out my membership agreement.

First, when I signed up for Ballys Scandanavian, they charged me $7,000 for a lifetime membership. Then it went to Ballys, and now L.A. Fitness.

Problem, L.A. Fitness assumed the contract from Ballys. Well friends, my contract included my wife, and together we signed off on the same contract. Now, L.A. Fitness only wants to honor my portion of the contract without providing for my wife who was on the same agreement together with me originally.

I went to L.A. Fitness, and it was explained to me that my wifes life long membership with Ballys was not being honored because her dues were not paid in.

Now, because my dues were paid up, I was in the system, and I can still go to L.A. Fitness now. I dont understand how L.A. Fitness can assume half a contract. I'm going to file suit, or they are going to allow for my wife to enjoy their club.

This is going to cost L.A. Fitness allot of money if they do rectify this matter. Former Ballys employees told us they literally received no notice. One moment they were working for Ballys, and the next moment, they thought they would be unemployed, and then became employees of L.A. Fitness.

No constructive notice was given to us about the impending changes. The renewal notice from Ballys sent to us was for $99 worth of dues, and now L.A. Fitness wants close to $400.

I suppose I'm going to have to file suit.

Please sign me up for a class action lawsuit. This has to be illegal. I'm gonna call a lawyer right now. So I paid a high monthly membership for 3 years to get the $9/month monthly membership for NOTHING?! I hate Ballys in every way.
